As clients live longer and, in some circumstances, their mental health fails, disputes over whether the will maker had testamentary capacity to make the will become more common. We can provide expert advice on potential challenges to wills or defending a will. We can also provide advice to both executors and potential applicants on family provision applications, where family members do not consider that they have been adequately provided for in a will.
Our firm has also had significant experience in advising both executors and beneficiaries on all matters concerning estate administration where disputes arise.
The Supreme Court of Queensland has appointed our partner, Michael Klatt, as administrator of estates where the Court has removed executors. We are often asked to be involved in contentious estate matters and assist in bringing these to a conclusion.
